Service Description
South Carolina Pest Control provides professional pest management and extermination services to residential and commercial clients throughout the state of South Carolina. Our services include, but are not limited to, inspection, identification, treatment, and monitoring of common pests such as termites, rodents, ants, cockroaches, mosquitoes, bed bugs, spiders, and other nuisance wildlife. Treatment methods may involve the application of EPA-registered pesticides, baits, traps, exclusion techniques, and integrated pest management strategies tailored to the specific conditions of each property. All services are performed by licensed technicians in accordance with South Carolina Department of Pesticide Regulation standards and applicable federal guidelines. Service frequency, scope, and pricing are determined based on initial inspection findings and mutually agreed upon service agreements. We reserve the right to modify treatment protocols based on environmental conditions, pest biology, regulatory changes, or safety considerations without prior notice.
No Guarantee or Warranty
South Carolina Pest Control makes no express or implied guarantees regarding the complete elimination of pests from any treated property. Pest control results depend on numerous variable factors including, but not limited to, property construction, sanitation practices, environmental conditions, neighboring infestations, weather patterns, and client cooperation with recommended preventive measures. While we employ industry-best practices and licensed products, pest biology and behavior cannot be absolutely controlled. Any recurrence of pest activity following treatment does not constitute evidence of service failure. We do not warrant against future infestations, damage caused by pests, or secondary issues arising from pest presence. Our service warranty, if offered in writing as part of a specific service agreement, is limited to re-treatment at our discretion within the stated timeframe and does not extend to property damage, economic losses, or consequential damages.
User Responsibilities
Clients must provide accurate and complete information regarding property conditions, prior pest control treatments, known allergies, presence of pets, and other relevant factors that may affect service safety or efficacy. You agree to prepare the property as instructed prior to each service visit, which may include removing food items, securing valuables, relocating pets, and providing adequate access to treatment areas. Failure to follow preparation instructions may result in service rescheduling with applicable fees. Clients must promptly report any adverse observations following treatment and maintain reasonable sanitation and maintenance practices to support treatment effectiveness. You are responsible for ensuring that minors, pets, and vulnerable individuals remain away from treated areas for the duration specified by our technicians. Unauthorized interference with bait stations, traps, or treatment barriers voids any service commitments. Payment is due according to agreed terms, and overdue accounts may incur finance charges and suspension of services.
Limitation of Liability
To the maximum extent permitted by applicable law, South Carolina Pest Control and its officers, employees, agents, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, personal injury, property damage, or emotional distress, arising from or related to our services regardless of whether such damages were foreseeable or whether we were advised of the possibility thereof. Our total cumulative liability for any claim arising from these terms or our services shall not exceed the total amount paid by you for the specific service giving rise to the claim in the twelve months preceding the event. This limitation applies regardless of the theory of liability, whether contract, tort, negligence, strict liability, or otherwise. You acknowledge that pest control services involve inherent uncertainties and that pricing reflects this allocation of risk.
Intellectual Property
All content on our website, marketing materials, service documentation, treatment protocols, and proprietary methodologies are the exclusive intellectual property of South Carolina Pest Control or our licensors. This includes trademarks, service marks, logos, trade dress, copyrighted materials, and confidential business information. You are granted no license or right to use, reproduce, distribute, modify, create derivative works from, or display any of our intellectual property without express written consent. Client testimonials or photographs provided to us may be used for marketing purposes unless you provide written objection. Any unauthorized use of our intellectual property will be pursued through all available legal remedies.
Governing Law
These Terms of Service and any disputes arising from our services shall be governed by and construed in accordance with the laws of the State of South Carolina, without regard to conflict of law principles. Any legal action or proceeding relating to these terms must be brought exclusively in the state or federal courts located in Richland County, South Carolina, or the county of the client's principal residence if permitted by South Carolina law. You irrevocably consent to the jurisdiction of such courts and waive any objection to venue therein. The provisions of the South Carolina Unfair Trade Practices Act and other applicable consumer protection statutes shall apply where mandated by law notwithstanding any contrary provision herein.
Changes to Terms
South Carolina Pest Control reserves the right to modify, amend, or update these Terms of Service at any time in our sole discretion. Material changes will be communicated through direct notice to active clients or prominent posting on our website with a revised effective date. Your continued use of our services following notification of changes constitutes binding acceptance of the modified terms. We encourage periodic review of these terms. If you do not agree to modified terms, you must discontinue services and provide written notice of termination. Changes will not apply retroactively to disputes or events occurring prior to the effective date of modification.
